Terms of Service

Please read these Terms of Service ("Terms") carefully before using the ChatMend application and website (the "Service") operated by ChatMend LLC ("we," "our," or "us").

By using the Service, you agree to be bound by these Terms.

1. Description of Service

ChatMend is an application that uses artificial intelligence to analyze text message communication patterns and provide educational insights about relationship dynamics, including attachment style analysis, communication health scores, and relationship pattern identification.

2. Not Professional Advice

Results generated by the Service are based on AI analysis of text messages and may contain errors, inaccuracies, or misinterpretations. AI analysis cannot account for the full context of any relationship.

You should NOT rely solely on the Service's output to make decisions about your relationships, mental health, or personal safety. We strongly encourage you to consult with a licensed mental health professional for personalized guidance.

4. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.

5. Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service to harass, stalk, or monitor another person without their knowledge
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Use the Service in any way that violates applicable law
• Distribute, sell, or commercially exploit the Service's analysis results

6. User Accounts

You may create an account to access features such as analysis history synchronization. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

7. Purchases, Subscriptions and Refunds

Some features are paid. A Complete Report is a one-time purchase that unlocks the full analysis of one conversation for your account. A Monthly subscription includes a fixed number of Complete Reports per billing period, as stated on the pricing page; unused reports do not carry over. Prices are shown in US dollars and may change with notice on the pricing page; changes do not affect purchases already made or the current billing period of an active subscription.

Payments on the website are processed by Stripe; purchases in the Android app are processed by Google Play and are also subject to Google Play's terms and refund policy. We do not receive or store your card details. A subscription renews automatically each billing period until cancelled. You can cancel at any time from your account page; cancellation takes effect at the end of the current period, and you keep access until then. We do not offer partial-period refunds for subscriptions.

Refunds. Because a Complete Report is delivered immediately and consists of analysis generated for you on demand, it is generally non-refundable once delivered. If a report fails to generate, is unreadable, or you were charged in error, contact us within 14 days at support@chatmend.com and we will make it right, including a refund where appropriate. Nothing in this section limits rights you have under applicable consumer law.

A free Snapshot is offered once per account with a verified email address, for conversations up to the size stated on the pricing page. Creating additional accounts to obtain further free Snapshots is a violation of these Terms.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by ChatMend and are protected by applicable copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy or reliability of results.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy, completeness, or usefulness of any analysis or information provided by the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall ChatMend be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, emotional distress, personal injury, or property damage, arising out of or in connection with your use of the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless ChatMend from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Service or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be reflected by updating the "Last Updated" date.

13. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for any reason, including breach of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, USA, without regard to conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
